Right of Withdrawal

Mandatory Consumer/Customer Information

Consumers/Customers have a statutory right of withdrawal. A Consumer/Customer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either his/her commercial or self-employed professional activity (§ 13 BGB [German Civil Code]).

The Consumer/Customer has the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period shall be fourteen days from the date on which the Consumer/Customer or a third party designated by the Consumer/Customer, other than the carrier, took possession of the goods. In order to exercise this right of revocation, the Consumer/Customer must inform

by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of the decision to withdraw from this agreement. The Consumer/Customer can use the sample withdrawal form provided for this purpose, but this is not mandatory. In order to comply with the withdrawal period, it is sufficient for the Consumer/Customer to send the notification of exercising the right of withdrawal before the expiry of the withdrawal period.


CONSEQUENCES OF WITHDRAWAL

If the Consumer/Customer withdraws from this agreement, we shall refund to the Consumer/Customer all payments we have received from the Consumer/Customer, including delivery charges (with the exception of additional charges resulting from the Consumer/Customer choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date we receive notice of withdrawal from this agreement from the Consumer/Customer. For such a refund we will use the same means of payment that the Consumer/Customer used in the original transaction unless expressly agreed otherwise with the Consumer/Customer, and in no event will the Consumer/Customer be charged for such a refund. We may refuse a refund until we have received the goods in return or until the Consumer/Customer has proved that the goods have been returned, whichever comes first. The Consumer/Customer must return the goods immediately and in any case at the latest within fourteen days from the day on which the Consumer/Customer informs us

of the withdrawal from this agreement. The time limit shall be deemed to have been observed if the Consumer/Customer dispatches the goods before the expiry of the period of fourteen days. The Consumer/Customer shall bear the direct costs of returning the goods. The Consumer/Customer shall only be liable for any loss in value of the goods if such loss in value is due to handling of the goods which is not necessary for checking their condition, properties and functionality.

Exclusion or premature expiry of the right of withdrawal:
A right of withdrawal does not exist for goods which have been manufactured according to Consumer/Customer specifications or which are clearly tailored to personal needs. The same applies to articles which are not suitable for return due to their nature, such as eBooks (see also §9) and downloads. As with an order expressly agreed to by the customer, the right of withdrawal expires for eBooks and downloads, because the execution of the contract begins before the expiry of the withdrawal period.

In addition, a right of withdrawal does not exist for contracts concluded at a distance for the delivery of audio or video recordings or software in sealed packaging, if the delivered data carriers have been unsealed by the Consumer/Customer.

In addition, there is no right of withdrawal in the case of subscriptions to periodicals or the delivery of individual newspapers, periodicals and magazines.
